SIYERA LUXURY TRAVEL, LLC
TERMS AND CONDITIONS

These Terms and Conditions ("Agreement") govern the relationship between Siyera Luxury
Travel, LLC d/b/a Siyera Luxury Travel ("SLT," "we," "us," or "our") and the purchaser and/or
traveler ("Client," "Traveler," "you," or "your"). The individual making the booking represents and
warrants that he or she has the authority to act on behalf of all travelers included in the
reservation and agrees to bind all such travelers to these Terms and Conditions.
“Travel Services,” as used in these Terms and Conditions, includes all travel-related products,
arrangements, reservations, activities, and services arranged, facilitated, or booked by Siyera
Luxury Travel, LLC (“SLT”), including but not limited to air, rail, water, and ground transportation;
hotel and other lodging accommodations; restaurant reservations; food and beverage packages;
cruises; tours; sightseeing excursions; entertainment; concierge services; recreational activities;
and any other travel-related services or experiences.
By booking travel through SLT, you acknowledge and agree that you and all members of your
traveling party are bound by these Terms and Conditions:
I. AGENCY RELATIONSHIP AND DISCLAIMER OF LIABILITY
A. SLT is not Supplier or Tour Operator
SLT acts solely as an intermediary between you and the Suppliers identified on
your itinerary, invoices, confirmations, or travel documents. All transportation,
accommodations, tours, activities, and other travel services are provided by
independent Suppliers that are not owned, managed, supervised, or controlled
by SLT. You consent to and agree to the use of those suppliers named in the
proposal, itinerary or confirmation provided.
B. Supplier Responsibility
SLT does not have any special knowledge of the suppliers’ financial condition
and is not liable to you in the event that the suppliers become insolvent.
Furthermore, SLT shall not be responsible for any breach of contract or any
intentional, reckless or careless actions or omissions on part of such suppliers,
which result in any loss, damage, delay, or injury to you or group members.
Unless the term "guaranteed" is specifically stated in writing on your tickets,
invoice, or reservation itinerary, we do not guarantee any of such suppliers' rates,
bookings, reservations, connections, scheduling, or handling of personal effects.
SLT shall not be responsible for any injuries, damages, or losses caused to any
traveler in connection with terrorist activities, social or labor unrest, mechanical or
construction failures or difficulties, diseases, local laws, climactic conditions,
criminal acts or abnormal conditions or developments, or any other actions,
omissions, or conditions outside the SLT's control.

C. No Liability for Independent Arrangements
SLT is not liable or responsible for any arrangements made independently of
SLT. SLT assumes no responsibility for costs or fees you incur for independent
arrangements not booked through SLT , inclusive of, but not limited to, airline,
hotel, excursion, and travel protection related charges. If you make your own
flight arrangements, SLT is not responsible for any loss resulting from
cancellation or changes in international gateways, itineraries, or travel dates, and
cannot assist you with any schedule changes or delays related to air reservations
you have made on your own arrangement. It may not be possible to earn
frequent flyer or other loyalty points for reservations on your itinerary. With limited
exceptions, hotel and airline rewards or points cannot be redeemed for travel
arrangements made by SLT.
D. No Guarantee of Rates or Availability
All pricing, availability, promotions, and Supplier offers are subject to change until
confirmed and paid in full. Unless expressly stated in writing, SLT does not
guarantee Supplier pricing, availability, schedules, seating, room assignments, or
travel arrangements.
E. Travel Advisories and Safety
SLT has no special knowledge regarding unsafe conditions, travel advisories,
health hazards, or Supplier safety practices beyond publicly available
information. You are solely responsible for reviewing current travel advisories,
entry requirements, and health information issued by the U.S. Department of
State, CDC, TSA, DHS, and other governmental authorities.
F. Supplier and Tour Operator Terms and Conditions.
SLT makes all bookings solely as the booking agent for the travel Suppliers on
your itinerary. Separate Supplier terms and conditions will apply to your
reservation and purchase of travel-related goods and services that you select,
and you understand and agree that by booking travel through SLT , you are also
agreeing to the booking terms of each Supplier partner you have selected for
your itinerary. You agree that you will abide by the terms and conditions of
purchase imposed by any Supplier that you have selected as a service provider
on an itinerary you have approved.
G. Right to Correct Errors and Offers Subject to Availability.
We reserve the right to correct errors. In the event of any pricing error or
omission, we reserve the right to adjust such pricing or make any other
corrections. All offers, incentives and Supplier promotions are subject to
availability and may change without notice. You are advised to confirm
reservations well in advance of your anticipated dates of travel to avoid
disappointment, increases in fares and additional late booking fees.

II. ASSUMPTION OF RISK
A. You acknowledge that there are significant elements of risk while traveling, either
domestically within the United States or to foreign countries, participation in
activities associated with water sports, the outdoors, the presence or use of
motorized watercraft, and activities incidental thereto.
B. You understand and agree that travel to foreign countries has inherent risk and
that you assume all the risks associated with such travel and Travel Services
including but not limited to forces of nature; terrorism; civil unrest; war; accidents;
and transportation including land vehicles, boats, and aircraft that are not
operated or maintained to standards found in the United States of America. You
understand and assume the risks associated with altitude, illness, disease,
physical exertion, known or unknown medical conditions, tainted food, and
alcohol consumption, encounters with insects, or animals, exposure to the
elements including heat, sun, water and wind; conditions in the water including
tides, rip tides, animals; your own negligence or the negligence of others
including but not limited to the third-party suppliers and the entities providing the
Travel Services and that access to evacuation and/or suitable medical supplies
and support may not be available
C. You acknowledge that exposure to viruses or diseases including but not limited to
COVID-19 is an inherent risk of traveling, that cannot be controlled or eliminated
by SLT.
D. You acknowledge and assume the risk that certain criminal convictions may
result in denial of entry to another country or boarding of ships or airplanes.
E. You acknowledge and assume the risks inherent with the use and/or
consumption of alcohol and/or drugs (whether illegal, legal and/or prescribed)
that render you impaired.
F. You acknowledge and assume the risks inherent with traveling with valuable
items including but not limited to jewelry, important documents and papers and
electronics.
G. The Travel Services, by their very nature, carry with them certain inherent risks
that cannot be eliminated regardless of the care and steps SLT or third-party
supplier who is operating and providing Travel Services have taken to avoid
injuries. You acknowledge that the same elements that contribute to the unique
character of these Travel Services can cause loss or damage to equipment,
accidental injury, illness, or in extreme cases, permanent trauma, disability, or
death.
H. YOU EXPRESSLY AND VOLUNTARILY ASSUME ALL RISK OF DEATH,
ECONOMIC LOSS, DAMAGE TO PERSONAL PROPERTY OR PERSONAL
INJURY SUSTAINED WHILE PARTICIPATING IN TRAVEL SERVICES. You
acknowledge and agree that your participation in Travel Services is voluntary and
that you knowingly assume all such risks, including those risks not specifically

identified. You further understand that you are ultimately responsible for your own
safety.

III. CLIENT RESPONSIBILITIES
A. Accuracy of Information Provided to SLT. You are responsible for ensuring
that all names, dates of birth, gender information, and other identifying
information provided to SLT exactly match your government-issued identification
and travel documents.
B. Legal Authority. You represent that:
• you are at least eighteen (18) years old;
• you have legal authority to enter into this Agreement; and
• you are authorized to act on behalf of all travelers included in the booking.
C. Legitimate Bookings Only. You agree to make only legitimate reservations and
bookings and acknowledge that speculative, false, fraudulent, or abusive
bookings are prohibited.
D. Timely Review of Travel Services. SLT shall provide Client with itineraries,
confirmations, invoices, travel documents, and/or other documentation relating to
the Travel Services booked through SLT. Client is responsible for carefully
reviewing all such documentation for accuracy immediately upon receipt. Client
agrees to notify SLT in writing of any errors, omissions, discrepancies, or
requested corrections within forty-eight (48) hours of receipt. Failure to timely
notify SLT of any inaccuracies shall constitute acceptance of the information as
accurate, and SLT shall not be responsible for any costs, fees, losses, delays, or
damages resulting from untimely review or notification by Client.
E. Passports, Visas, Entry Requirements and Special Needs/Accessibility.
1. Travel Documents. You are solely responsible for obtaining and carrying
all required travel documents necessary and/or required for your travel,
including but not limited to:
• valid passports;
• visas;
• vaccination records;
• health documentation; and
• any other required entry or exit documentation.

Many countries require passports to remain valid for at least six (6)
months after the date of return.
2. Visas and Entry Approval. SLT does not control or guarantee the
issuance of visas or entry approvals. Denial of visas, boarding, or entry
does not entitle you to a refund from SLT.
3. Criminal Convictions. Certain criminal convictions may affect your
ability to enter foreign countries or board aircraft or cruise vessels. You
are solely responsible for verifying your eligibility to travel.
4. Health Requirements. You are responsible for obtaining all
recommended or required immunizations, medications, and health
screenings. SLT recommends consulting:
• the U.S. Department of State;
• the Centers for Disease Control and Prevention (CDC); and
• your healthcare provider.
5. Minors. Minors traveling without both parents or legal guardians may
require additional documentation. You are solely responsible for obtaining
all required consents and documentation.
6. Accessibility and Special Needs. Travelers with disabilities, medical
conditions, dietary restrictions, allergies, mobility limitations, or special
needs must notify SLT prior to booking.
SLT will make reasonable efforts to communicate requests to Suppliers;
however:
• accommodations are not guaranteed;
• accessibility standards may vary by destination;
• Suppliers may impose additional charges; and
• SLT is not responsible for the failure of any Supplier to accommodate
special requests or disabilities.
You acknowledge that certain destinations, transportation providers,
hotels, ships, or activities may not be fully accessible.
7. Refusal of Entry, Boarding, Services and Expulsion.
You understand and agree that each provider reserves the right to refuse
entry, boarding, service and to expel you from the Travel Services for
certain conduct and/or behaviors including but not limited to engaging in

unsafe conduct, illegal conduct, conduct that jeopardizes the health and
safety of yourself and/or others; alcohol or drug impairment; failure to
follow the entity providing the Travel Service’s code of conduct, rules and
safety precautions. You further acknowledge that you understand and
agree that you will not be entitled to any refund or credit for any unused
portions of your Travel Services and that additional costs will be incurred
to address the particular situation including but not limited to additional
transportation costs, additional costs for accommodations and costs of
alternative flights and, in the event that you purchased travel insurance, it
is unlikely that these costs will be covered by the travel insurance.

IV. PAYMENTS, CHANGES, CANCELLATIONS, AND REFUNDS
A. Responsibility for Payment. You are responsible for all charges, fees, taxes,
duties, penalties, and assessments related to your travel arrangements. By
providing SLT your credit card information, you authorize SLT to process
payments on your behalf with Suppliers.
B. Final Payment. All reservations are subject to Supplier payment deadlines and
cancellation policies. Failure to make timely payment may result in cancellation of
your reservation and forfeiture of deposits or payments.
C. Merchant of Record. As discussed in Section I.A, SLT is not the supplier or tour
operator. As such, SLT is not the merchant of record for any of the requested
travel-related services or components. The merchant of record for your bookings
will be listed as the supplier on your invoices and statements.
D. Cancellation Requests. In some cases, there is NO REFUND once a booking
is made and under deposit. You may not be entitled to a refund if you change or
cancel your travel plans after confirmation of a booking. All cancellation requests
must be sent to SLT in writing. As a result of cancellation or changes to
confirmed bookings, third-party Supplier’s cancellation penalties will apply.
Cancellation fees will be charged to the credit card or other payment method you
authorized to pay for travel services or deducted from the Supplier’s refund.
E. Changes to Bookings After Initial Deposit. ANY changes made to your
existing reservations are subject to the current rates, promotions, and terms at
the time of change.
F. Service Fees for Changes, Cancellations and Additional Services. We
reserve the right to charge fees up to ten percent (10%) of the total cost of the
booking for services rendered in the event that you elect to change and/or cancel
your reservations, which must be paid prior to any changes or cancellations
processed. We also reserve the right to charge fees for other services related to
your travel including but not limited to arranging tours, excursions, transportation,
special requests/needs and dining, which must be paid prior to the additional
services being rendered.
G. Chargebacks. EXCEPT IN CASES OF FRAUD OR UNAUTHORIZED
CHARGES, YOU AGREE NOT TO INITIATE CHARGEBACKS OR PAYMENT

DISPUTES RELATED TO VALID TRAVEL BOOKINGS, SUPPLIER TERMS, OR
APPLICABLE CANCELLATION PENALTIES.
If you improperly initiate a chargeback or payment dispute, SLT reserves the right
to recover all associated costs, including reasonable attorney fees and collection
expenses.

V. AIR TRAVEL, BAGGAGE, AND TSA REQUIREMENTS
A. Airline Schedule Changes and Cancellations. Airlines may change flight
schedules or cancel flights. SLT is NOT responsible for any additional costs or
fees imposed by the airlines due to any changes in schedules or flight
cancellations. It is the responsibility of the passenger to check for last minute
airline flight time changes within 24 hours of departure. SLT is not responsible
for changes that may occur within 24 hours of original flight departure time. In
addition, you may find more information about your options as passenger at
https://www.transportation.gov/airconsumer/fly-rights.
B. Baggage Fees. Due to continual changes in airline baggage policies it is
suggested that you inquire with your airline's website for up-to-date fees &
information. SLT is NOT responsible for additional fees incurred for baggage or
seating. BAGGAGE FEES ARE NOT PART OF AN ALL-INCLUSIVE PACKAGE.
C. TSA Regulations. You must abide by TSA regulations when traveling by air. To
answer any questions, you might have regarding airline regulations and the
specifics with the latest security policies, please visit www.tsa.gov or call (866)
289-9673.
VI. TRAVEL INSURANCE
Travel insurance is always recommended but is optional. There are different types of
travel insurance; coverage and exclusions vary by insurance carrier. It is important that
you understand the coverage and exclusions of the travel insurance. SLT does not
provide advice or guidance on coverage or exclusions of travel insurance policies. Prior
to purchasing or waiving travel insurance, it is your obligation to understand the
coverage and exclusion of any travel insurance. Any information on travel insurance
provided by SLT is provided by a third-party. SLT is not an insurance carrier or company
and, therefore, does not offer or provide any advice or guidance on the coverage and
exclusion of any travel insurance policy. You should contact the insurance carrier to
obtain advice with respect to any particular coverage or exclusion of the travel
insurance policy. Use of and access to the information using the above links does not
create any duty between you and SLT. In the event that you do not elect to purchase
travel insurance, then you hereby acknowledge that you understand that declining
travel insurance could result in the loss of travel costs; require more money to address
the situation; and/or there may be no means to recoup losses or additional costs.
You are solely responsible for reviewing and understanding all policy terms, exclusions,
and coverage limitations.

VII. FORCE MAJEURE.
SLT will not be in breach of these terms and conditions or otherwise be liable to you,
for any failure or delay in performing an obligation under this Agreement that is due to
any of the following causes, to the extent beyond its reasonable control: acts of God,
accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion,
breakdown of communication facilities, including web host and internet service provider,
breakdown or malfunction of equipment, destruction of or serious damage to facilities,
natural catastrophes including, but not limited to extreme weather events, floods and
volcanic eruptions, governmental acts or omissions, changes in laws or regulations,
national strikes, fire, explosion, generalized lack of availability of raw materials or
energy, and any other unforeseen circumstance which is beyond the control of SLT.
THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL
TRIPS.
In addition, each of SLT ’s Suppliers have terms and conditions which include Force
Majeure provisions. In the event that a Force Majeure event occurs, those Suppliers
may be entitled to, and may in their sole and absolute discretion, vary, postpone or
cancel any itinerary or arrangement in relation to the trip. Payment of any refund to you
as a result of the non-performance of any obligations hereunder shall remain in the sole
and absolute discretion of the Supplier pursuant to their policies, although SLT shall use
its reasonable efforts to secure reimbursement for you where possible.

VIII. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SLT SHALL NOT BE LIABLE FOR
ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR
PUNITIVE DAMAGES. SLT'S LIABILITY, IF ANY, SHALL NOT EXCEED THE AMOUNT
PAID DIRECTLY TO SLT FOR PROFESSIONAL TRAVEL ADVISORY SERVICES.
Any assistance provided by SLT in resolving Supplier disputes or travel disruptions is
provided as a courtesy only and does not create additional legal obligations or liability.
IX. GOVERNING LAW, VENUE, AND DISPUTE LIMITATIONS
This Agreement, and the rights and obligations of the parties hereunder, shall be
interpreted, construed, enforced and governed by North Carolina law, without regard to
the choice of law rules of North Carolina. Any claims relating to the interpretation or
enforcement of this Agreement may be brought only in the Superior Court of
Mecklenburg County, North Carolina or the U.S. District Court for the Western District of
North Carolina.
X. GENERAL PROVISIONS
A. Entire Agreement. These Terms and Conditions constitute the entire agreement
between the parties and supersede all prior communications or understandings.
B. Severability. If any provision of this Agreement is determined to be invalid or
unenforceable, the remaining provisions shall remain in full force and effect.

C. Modifications. SLT reserves the right to modify these Terms and Conditions at
any time. Updated versions become effective upon posting or distribution.
D. Electronic Acceptance. Electronic acceptance of these Terms and Conditions
shall be deemed legally binding and enforceable to the same extent as a signed
written agreement.

BY BOOKING TRAVEL THROUGH SIYERA LUXURY TRAVEL, LLC, YOU ACKNOWLEDGE
THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS AND
CONDITIONS.
